TERMS AND CONDITIONS

These Terms and Conditions (“Terms”) govern your access to and use of the website www.lensandliving.co.za (“the Website”), and your purchase of any products and/or services offered by Lens and Living (“we”, “us”, “our”, or “the Company”), including photographic equipment, sublimation gifts, networking solutions. 

By accessing the Website, placing an order, or using our services, you (“you”, “the Customer”, “the User”) agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Website or our services.

1. About Us

1.1  Lens and Living is a South African business trading as “Lens and Living”, operating from KBN Lens Living Group (Pty) Ltd, registration number 2025/803864/071.2 

Our physical/trading address is: 61 Humewood drive, Parklands Cape Town.

1.4  These Terms are governed by the laws of the Republic of South Africa, including the Consumer Protection Act 68 of 2008 (“CPA”), the Electronic Communications and Transactions Act 25 of 2002 (“ECTA”), and the Protection of Personal Information Act 4 of 2013 (“POPIA”), to the extent that they apply.

2. Our Products and Services

2.1  We sell photographic equipment and accessories, sublimation and personalised gifts, networking solutions and equipment, and provide small home improvement and installation services, as listed on the Website from time to time.

2.2  We make reasonable efforts to display our products accurately, including images, descriptions, and pricing. However, colours, finishes, and specifications may vary slightly from what is displayed due to photography, screen settings, or manufacturer changes, and we do not guarantee that any description is fully accurate, complete, or error-free.

2.3  Where we provide services (such as networking installations or home improvement work), the scope of work, timelines, and any site-specific requirements will be agreed with you in advance, either via the Website, in writing, or by quotation. Service quotations are valid for the period stated on the quotation, or if none is stated, for 14 days.

2.4  All products are subject to availability. We reserve the right to discontinue any product or service, or to limit quantities, at any time without liability to you, save as required by law.

3. Orders and Acceptance

3.1  An order placed by you through the Website constitutes an offer to purchase the relevant products or services, subject to these Terms. No order is accepted by us until we have confirmed it in writing (including by email) or, in the case of goods, until we have dispatched the goods to you.

3.2  We reserve the right to refuse or cancel any order, including where a product is out of stock, incorrectly priced or described, where we suspect fraudulent or unauthorised activity, or where we are unable to obtain authorisation for payment. If we cancel an order after payment has been received, we will refund you in full within a reasonable time.

3.3  You are responsible for ensuring that the information you provide when placing an order (including delivery address and contact details) is accurate and complete. We are not liable for delays or non-delivery caused by incorrect information supplied by you.

4. Pricing and Payment

4.1  All prices on the Website are displayed in South African Rand (ZAR) and, unless stated otherwise, are inclusive of VAT where applicable. Prices exclude delivery charges, which will be shown separately at checkout or in your quotation.

4.2  We reserve the right to change prices at any time, but changes will not affect orders that we have already confirmed.

4.3  Payment may be made via the methods indicated on the Website at checkout (which may include EFT, credit/debit card, or approved online payment gateways). Payment for services may be structured as a deposit and balance, as agreed in the relevant quotation.

4.4  Goods remain our property until payment has been received in full. Risk in goods passes to you on delivery.

4.5  We take reasonable steps to keep online payments secure but are not liable for losses arising from unauthorised access to your payment details that is not caused by our negligence.

5. Delivery

5.1  We aim to deliver or make available for collection products within the timeframes indicated on the Website or in your order confirmation. Delivery timeframes are estimates only and are not guaranteed.

5.2  Delivery costs are calculated based on your location and the size/weight of your order and will be shown before you complete checkout.

5.3  We are not liable for delays caused by courier or postal service providers, incorrect delivery information supplied by you, or circumstances beyond our reasonable control (see clause 12).

5.4  Please inspect goods on delivery. Any visible damage or shortage should be reported to us within 48 hours of delivery.

6. Returns, Exchanges and Refunds

6.1  Cooling-off right (electronic transactions): where you have purchased goods through the Website without any face-to-face contact with us, you may, in terms of the Electronic Communications and Transactions Act, cancel the transaction within 7 (seven) days of receiving the goods, without reason and without penalty, save that you will be liable for the direct cost of returning the goods. This right does not apply to goods made to your specification, personalised items (including sublimation/custom gifts), or services that have already been performed with your consent.

6.2  Defective or faulty goods: in accordance with the CPA, if goods supplied to you are defective, unsafe, or do not comply with the applicable warranty, you may, within 6 (six) months of delivery, return the goods and choose to have them repaired, replaced, or refunded, at your election.

6.3  To request a return, please contact us with your order number and reason for return before sending any goods back. Goods returned for reasons other than defect must be unused, in their original packaging, and accompanied by proof of purchase.

6.4  Approved refunds will be processed within a reasonable time using the same payment method used for the original purchase, unless otherwise agreed.

6.5  Services: where you are dissatisfied with services performed (e.g. networking installation or home improvement work), please notify us in writing within a reasonable time of completion so that we may investigate and, where appropriate, remedy the work at no additional charge.

7. Warranties

7.1  Manufactured products sold through the Website may carry a manufacturer’s warranty, the terms of which will be provided with the product where applicable. We will assist in facilitating manufacturer warranty claims where reasonably possible.

7.2  We warrant that services will be performed with reasonable skill and care and in accordance with any specification agreed with you. This warranty does not cover damage caused by misuse, normal wear and tear, unauthorised repairs, or failure to follow our care/use instructions.

7.3  Nothing in these Terms limits any right or remedy you have under the CPA, which applies in addition to any warranty we provide.

8. Website Use and Intellectual Property

8.1  All content on the Website, including text, images, logos, graphics, and software, is owned by or licensed to us and is protected by South African and international intellectual property laws. You may not reproduce, distribute, or use this content for commercial purposes without our prior written consent.

8.2  You agree to use the Website only for lawful purposes and not to engage in any conduct that may damage, disable, or impair the Website, or interfere with any other user’s access to it.

8.3  Where the Website allows you to create an account, you are responsible for maintaining the confidentiality of your login details and for all activity that occurs under your account.

9. Privacy and Personal Information

9.1  We process your personal information in accordance with POPIA and our Privacy Policy, which is available on the Website (or available on request). By using the Website and providing your information, you consent to such processing for the purposes of fulfilling your order, providing services, and, where you have opted in, marketing communications.

9.2  We do not sell your personal information to third parties. We may share your information with service providers (such as couriers or payment processors) strictly for the purpose of fulfilling your order.

9.3  You may withdraw consent to marketing communications, or request access to, correction of, or deletion of your personal information, by contacting us using the details in clause 1.

10. Limitation of Liability

10.1  To the maximum extent permitted by law, we shall not be liable for any indirect, special, or consequential loss or damage arising from your use of the Website or our products and services, including loss of profits, loss of data, or business interruption.

10.2  Our total liability to you for any claim arising out of or in connection with an order shall not exceed the amount paid by you for the relevant product or service giving rise to the claim.

10.3  Nothing in these Terms is intended to limit any liability that cannot lawfully be limited or excluded, including liability for death or personal injury caused by our negligence, fraud, or liability arising under the CPA that cannot be excluded.

10.4  For home improvement and installation services performed on your property, you should ensure your property is adequately insured. We carry appropriate liability cover for the services we perform and will make details available on request.

11. Indemnity

11.1  You agree to indemnify and hold us harmless against any claims, losses, or damages arising from your misuse of the Website, breach of these Terms, or provision of inaccurate information, save to the extent caused by our negligence or wilful conduct.

12. Force Majeure

12.1  We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including load shedding, network/telecommunications failure, natural disasters, strikes, or supplier failures.

13. General

13.1  These Terms constitute the entire agreement between you and us in relation to your use of the Website and purchase of products or services, and supersede any prior agreement or understanding.

13.2  If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

13.3  We may update these Terms from time to time. The version applicable to your order is the version published on the Website at the time you place your order. Continued use of the Website after changes are posted constitutes acceptance of the updated Terms.

13.4  These Terms are governed by the laws of the Republic of South Africa, and any disputes will be subject to the non-exclusive jurisdiction of the South African courts. Nothing in this clause limits your right to refer a dispute to the National Consumer Commission or an accredited consumer protection body under the CPA.
